Donating a Car to Charity

Donating a car is a way to support a charitable organization while still reaping an economic benefit through a tax deduction. All donors should be aware that tax deductions for used automobiles, boats or airplanes are available only to those individuals who donate to a qualified charity and who itemize deductions on their tax returns. Following are some tips to consider when deciding whether to donate your car to charity.

Do make sure that you are donating to an eligible organization. Tax deductions are available for donations made to §501(c)(3) organizations, public charities which the Internal Revenue Service has determined to be tax-exempt. To verify an organization's qualified status, contact the Public Charities Division at (617) 727-2200, ext. 2101; the IRS Tax Exempt/Government Entities Customer Service at 1-877-829-5500; or look for IRS Publication 78 in your local library's reference section or on the IRS website. Churches, synagogues, temples, mosques, and governments are not required to register with the Non-Profit Organizations/Public Charities Division or to apply to the IRS for tax-exempt determination. They may not be listed in Publication 78, but donations to these institutions are tax deductible.

Do ask the charity plenty of questions. Find out what the organization's mission is and how your donation will help it. Ask if your donation can go to a particular program or service that interests you or whether it must go only into the charity's general fund. Do not donate to an organization that avoids talking about its charitable purpose or refuses to send you information.

Do ask what the charity will do with your car. Some charities refurbish cars and give them to people in need. Some technical schools use cars in their auto shop programs. Other organizations simply resell the car or sell its parts and use the proceeds for their charitable purposes.

Do ask if the charity handles all aspects of your donation. Many charities contract with for-profit companies to handle all the details of motor vehicle donations. If this is the case, ask how the money from your car donation is split between your charity and the for-profit company.

Deduct only the amount allowed by law. Section 884 of the American Jobs Creation Act of 2004 added sections 170(f)(12) and 6720 to the Internal Revenue Code and changed the rules for donations of motor vehicles, boats, and airplanes beginning in 2005. There are different rules concerning deductions, depending on the value of the car and on whether the charity will keep and use the car or whether it will sell the car (or its parts). The IRS has published "A Donor's Guide to Vehicle Donations" (Publication 4303), which details the new rules. You can obtain Publication 4303 from the IRS at your local IRS office, or by calling 1-800-TAX-FORM (1-800-829-3676), or from the IRS website.

Do have your motor vehicle appraised by a qualified professional appraiser if it is worth more than $5,000.

Do make sure you have the title to your vehicle. A charity should not accept your donation without a title. To obtain a duplicate title, visit your local Registry of Motor Vehicles branch or visit the Registry's website.

Do take responsibility for transferring the title at the time of the donation. An assignment of title should be made only to the charity or an authorized private, for-profit agent of the charity.  The for-profit agent of the charity should be subject to the charity’s oversight in order for the agency to be valid for tax-deductibility purposes.  The IRS has published "A Charity’s Guide to Vehicle Donations" (Publication 4302), which details the required terms of the agency relationship. You can obtain Publication 4302 from the IRS at your local IRS office, or by calling 1-800-TAX-FORM (1-800-829-3676), or from IRS website links to PDF file.

On the back side of your title, you should assign the title to the charity or an authorized agent of the charity, enter the correct mileage from the odometer, and sign and date the form. Be sure to make and keep a copy of both sides of your title.

Do maintain a personal record of your donation. Items that should be included in your record include:

The written contemporaneous acknowledgment from the charity;
The name and address of the organization to which you contributed;
The date and place where your vehicle was picked up;
A reasonably detailed description of the donated car or a photograph of the car;
The fair market value of the car at the time of the contribution and how that value was calculated;
A signed copy of the appraisal, if the motor vehicle was appraised;
Any terms or conditions attached to the car donation;
How you obtained the car (by purchase, gift, inheritance, etc.) and the date; and
A copy of your title, registration, and any receipts you are given by the tow company or the charity.

DONATE CAR: THE BEST TAX DEDUCTION

Federal regulations have changed recently in the area of car donation, and there's a lot of misinformation floating around for those who want to donate a car for tax deduction. It seems like with these new regulations, it's no longer a financially good choice to donate a car. However, this analysis is an oversimplification. Donating your car can be financially beneficial; it just depends on whom you donate it to.

Donate a Car for Tax Deduction

Vehicles for Change is an organization that accepts a variety of car types for donation and provides them to families in need. The vehicle you're considering donating probably falls under one of these four categories:

A vehicle in good condition a family can use. These cars, trucks, or SUVS typically have less than 150,000 miles on them and are usually 10-12 years old. These cars can normally be fixed up for use for under $1000. After they are repaired by Vehicles for Change technicians, they will give at least two years of reliable service. The donor of these vehicles receives the full fair market price in tax deductions.
A luxury vehicle in good condition. Luxury vehicles are typically expensive to maintain and repair. Therefore, they aren't ideal vehicles for lower-income families. With this in mind, Vehicles for Change performs the repairs and then sells the repaired vehicles to Freedom Wheels – a non-profit used car organization operated by Vehicles for Change. The proceeds from these sales allow Vehicles for Change to repair more cars for families in need. People who donate these luxury cars receive the selling price in deductions, which is usually around the fair market value.
A vehicle that needs a major repair, but is otherwise in good condition. Typically, these vehicles aren't ideal for donating to a needy family. Therefore, these vehicles are sold to Freedom Wheels. People who donate these kinds of cars receive deductions for the full fair market value of the car, minus the estimated cost of the repairs. This estimate is provided by Vehicles for Change.
A vehicle that isn't financially feasible to repair. Some cars are too damaged to be worth repairing by Vehicles for Change. Technicians from the organization will perform minor repairs and then auction it off to the organization's partners, usually with a minimum bid. Proceeds go to repairing more vehicles for families in need. Donors can donate the selling price of the car from their taxes, which is usually 1/3 to ½ of fair market value.
When you donate a car, tax deduction can be substantial, making car donation one of the most financially sound ways of getting rid of an unwanted vehicle. What's more, you can help your community by choosing to donate.

Why Donate to Vehicles for Change?

Tax deduction can be very substantial if you donate a car, so why is there so much information online saying otherwise? This has to do with the nature of Vehicles for Change as an organization. The fact is, 99% of charities who accept donated cars sell the cars. When they accept cars, they have the resell value in mind. Vehicles for Change is different.

Money is needed by all charities. The mission of Vehicles for Change, however, is to donate cars to families in need. Many families are stuck in poverty despite being qualified for high-paying jobs. There are many areas in the United States without public transportation; however, even in areas with reliable public transportation, running errands and getting to work is difficult. Also, in many cases, the breadwinners of many lower-income families are paid by the hour. This means if inclement weather or sickness prevents them from reaching their job, they are not paid. Even one day without pay can be a big problem for a family without much money to go around.

When charities resell cars, they take into account only the monetary value of the car, but Vehicles for Change is different; the Vehicles for Change approach gets vehicles to people in need and gives donors significant benefits as well.

Who Benefits from Vehicles for Change?

Vehicles for Change is, therefore, a different kind of charitable organization. So, who benefits from the organization's approach?

You. By donating to Vehicles for Change, you make a solid financial decision. Those who donate a car for tax deduction can't do any better than an organization like Vehicles for Change. The company's approach of donating the vehicle rather than flipping the vehicle for money is what gives you the tax benefits you deserve for such a large donation.
Lower-income families. Donated food and money can only go so far for lower-income families. Food and money run out. However, when earners in lower-income families are able to make their own money, they can achieve a financial stability that was previously only a dream. Vehicles for Change provides independence, stability, and a real chance for advancement.
Your community. A community is made up of families. When just one of these families go hungry, they whole community suffers. By donating a vehicle, you are taking responsibility for your position in the community. Having a car gather dust in your garage or driveway doesn't do anyone any good. By donating your car, you give something of great tangible value. Your whole community benefits from your generosity.
The world. Hunger, poverty, and suffering anywhere in the world are our collective responsibility. By taking steps to help one family, you can make a different in the entire world.
Vehicles for Change is not just another charity. When you donate a car, the tax deduction provided by Vehicles for Change helps you, and the car itself allows for concrete improvement in the lives and prospects of a family.

Documents Necessary for Car Donation

Car donation is actually a very simple process that only requires a few documents. Whether you want to donate a car for tax deduction, to do good for your community, or both, the documents required aren't difficult to obtain and prepare.

Requirements for donating a car vary state by state. Vehicles for Change accepts cars from all over the country on a case-by-case basis. As the organization is located in Maryland, almost all vehicles in Maryland, Virginia, and Washington, D.C., are accepted. The document always required for donating a car is the title. To legally donate a car to charity, the title must be transferred to the charitable organization.

First, you must request a duplicate of the car's title from your local DMV. This can often be done online. Then, you must print and sign your name under the “seller” line. If there are two people on the title, both need to print and sign. Under “buyer,” it is necessary to write the name of the organization you are donating to; in this case Vehicles for Change. Be sure to fill the information out correctly the first time. The DMV is strict about these documents, and they won't accept them if there are things scribbled out. Once you are finished, be sure to make a copy for your records.

If you used the services of an institution to finance your purchase of the vehicle and this is referenced in the vehicle's title, you will probably need a lien release. This is simple. Contact the lending institution to ask for a letter confirming you paid off your vehicle in full. This letter should be on the institution's letterhead, and should include the make, model, year, and VIN of the car.

These documents are simple to obtain and prepare. Donating a car is certainly not the complicated process it is made out to be.

Why Donate a Car Instead of Simply Giving Money? recipient image-01.png

Donating a car to charity might seem excessive. If you want to do something good, you may ask yourself, why not donate money?

The fact is most financial donations are a one-time thing. Donated money and food run out. What's more, a lower-income family is left dependent on the will of a charitable institution. If the institution isn't prompt in distributing these funds, a family might be left in the lurch with nowhere to turn.

There is also the issue of pride. Poverty is not a crime or a failing. However, our cultural values in the United States leave many lower-income people feeling as if it is. It can be difficult for one to ask for much needed assistance when shame is such a powerful emotion. A car donated to Vehicles for Change is purchased by lower-income families at a price they can afford. The vehicle is guaranteed to run for at least two years. Not only is this is a longer lasting donation than most financial contributions, but the car presents the family with the opportunity to help itself.

Vehicles for Change works with people to give them the solutions they need. Donate a car for tax deduction, and a chance for independence and advancement is more possible than a one-time financial donation can provide.

Donating a Car, Step by Step

Not only is obtaining the necessary documentation for car donation a breeze, the process itself is as simple. To donate a car for tax deduction, obtain these documents and properly fill them out. Then, visit Vehicles for Change online. The organization has a simple form that takes less than ten minutes to complete. It can be completed online or printed out to be filled out manually, and a hard copy can be emailed, faxed, or mailed.

The form asks for information about the donor and the vehicle. The information is kept strictly confidential. If a physical copy is submitted, it's shredded once Vehicles for Change finishes with it.

Once the documentation is submitted, Vehicles for Change will contact you to set a pick up time. You meet the tow truck yourself to turn over the necessary documentation and the keys. Then, after your vehicle information is processed, the tax receipt is mailed to you. This is how simple it is to donate a car for tax deduction.

Vehicles for Change by the Numbers

Since 1999, Vehicles for Change has awarded 5,000 vehicles to families in need. The benefits these families have received from these donated vehicles have been life-changing. 75% of the recipients reported missing far fewer days of work than they did before they had cars. The same percentage also within the first year of owning their vehicles were able to increase their earnings or even get an entirely new, and better, job. The average annual increase in earnings was $7,000.

The daily commute of vehicle recipients was decreased by a full 90 minutes. 93% reported decreased levels of stress, which wasn't the only health benefit. 98% were able to take their children to the doctor, and 87% were able to participate in activities beneficial to their health.

Families were also able to become more involved in their communities as a result of their new vehicles. A full 100% of recipients reported taking their children to after school activities. 55% volunteered in the community, and 75% attended religious services.

Mesothelioma Law Firm

For decades, mesothelioma, a life-threatening disease that can affect the lungs, abdomen, and several other major organs, has been linked to prolonged exposure to asbestos, resulting in many people seeking a mesothelioma law firm to get justice and help them cover the overwhelming expenses associated with the disease.

Typically, mesothelioma victims were exposed to asbestos while working at a job site that used asbestos-containing materials (ACMs). In many cases, the manufacturers of asbestos and ACMs knew of the hidden dangers and risks of asbestos, yet failed to inform the public, as asbestos was an extremely profitable mineral. Because of the hindrance of information, workers who developed health issues from asbestos exposure may be eligible for financial compensation to cover expenses such as lost wages, medical bills, emotional suffering, physical pain, and more.

If you suffer from mesothelioma, asbestos-related lung cancer, or asbestosis, you may be eligible for a large amount of compensation. Currently, there is over $30 billion in asbestos trust funds, set up for those who have been diagnosed with an asbestos-related illness. Fill out our form to receive our free Financial Compensation Packet. Our packet is loaded with information on leading mesothelioma attorneys in your area, how to file a claim for asbestos trust funds, how to get paid in 90 days, and more.
What Does a Mesothelioma Law Firm Do?
Law firms specializing in mesothelioma are different from any other type of law firm. Whereas other firms may specialize in areas like car accidents or nursing home abuse, mesothelioma law firms focus primarily on mesothelioma and other asbestos-related diseases. It’s not recommended to retain legal representation from a general practice law firm or even a personal injury firm that specializes in a wide array of injury cases. You’ll need an attorney who specifically specializes in mesothelioma cases, as these types of lawsuits are extremely intricate and require vast, in-depth understanding of asbestos exposure and diseases.

Attorneys at these law firms have knowledge and experience regarding federal and state laws concerning asbestos use and its history in the workforce. They also have sharp investigative skills and are able to dig deep to uncover when and where companies and/or other entities exposed workers to asbestos. Additionally, these law firms are comprised of educated attorneys who understand the legal process involving courts, trials, settlements, and appeals.

Review of Our Services

Dale R.“When dad was diagnosed with mesothelioma, our world was turned upside down. Not knowing what to do next, I researched and interviewed many firms. Some firms were nothing more than marketers. Others offered up call screeners to take my name and number. And then there was Mesothelioma Lawyer Center. It was with them that I found peace, knowledge and professionalism. They have done everything they said they would do and then some. Contacting Mesothelioma Lawyer Center was the best decision I could have made for my family.”

~ Dale R.
Moreover, an experienced firm understands that the victim is already suffering enough because of the medical and financial problems associated with asbestos-related diseases. As a result, the firm will handle most everything regarding the lawsuit, including fighting for the legal rights of the client, interviewing witnesses, obtaining medical history, litigation, and more.

An experienced law firm also understands the severe emotional impact that living with mesothelioma brings, not only to victims, but to family members and loved ones as well. An good firm takes this into account and helps ease the minds of victims and their loved ones throughout this enduring process.

What Should I Look for When Hiring an Asbestos Law Firm?
Unfortunately, not all law firms specializing in mesothelioma are the same. While some may have several years of experience, other firms are relatively new to the area of mesothelioma. In addition, some law firms may concentrate on other areas of law besides mesothelioma while another firm may solely focus on asbestos cases.

Aside from using your good judgement when determining which law firm you should use, there are several factors you should consider:

The law firm should have experience in dealing with mesothelioma cases.
The law firm should be extremely knowledgeable in asbestos laws and prior cases.
Look for a law firm that focuses solely on asbestos-related cases.
Look for law firms with a stellar reputation in handling asbestos cases.
The law firm should not only understand asbestos laws, but should also have extensive knowledge of medical problems associated with asbestos diseases.
The law firm should always keep you updated on what’s going on in your case. Although attorneys are busy people, they should be accessible.
You should always get an initial consultation at no charge before deciding on a firm.
Keep in mind that it’s not recommended to retain a law firm that promises you that you will win your case no matter what. Although statistics show that the majority mesothelioma victims do go on to win their lawsuits, there are a variety of factors involved, and no case is guaranteed. An experienced law firm will help you to understand your chances and what is involved, but will never assure that your case is 100% guaranteed.

Making Things Easier
Although a law firm will do the majority of your case work, it’s always a good idea to be prepared and make things easier so that the process gets rolling faster.

First, make sure to gather your medical documents, including when and where you were diagnosed, and bring this information to your initial meeting. This will allow the firm to determine if your case can be taken on.

Next, be prepared to provide the law firm with your work history and information including the full company name, address, phone number, your job role, and how long you worked there.
Finally, start keeping track of all expenses used pertaining to your disease. For example, always keep a copy of medical bills, hospital visits, mileage used to get to appointments, medical supplies, and anything other expense you paid out due to your illness.

How Can a Law Firm Personally Help Me?
When first getting started, victims usually have a plethora of unanswered questions regarding asbestos and their rights. A good law firm should be able to provide you with following information:

Evidence Related to Your Exposure: Once you provide the law firm with your work information, they should be able to investigate and determine how asbestos was used at your workplace. In some cases, they may already have the information available.

If You Truly Have an Asbestos Claim: Asbestos law firms understand what’s needed in order to have a true asbestos claim. With this knowledge, they are able to determine how strong your case is and what the estimated chances are that you’ll win. Most attorneys make sure they’re confident in your case before taking it on. Be wary of any attorney who promises to take your case without knowing any of the details or an attorney who claims they can get you an exact amount of compensation before reviewing your case.

Your Case Worth: If the firm decides you have an asbestos case, they will then be able to come up with an average figure of how much your case is worth. This is including past expenses, daily expenses, medical bills, lost wages, emotional trauma, physical suffering, future expenses, and much more. Keep in mind, however, that there is no set formula as to how much your award amount may be. The aforementioned factors, along with other details, such as if your former company has a trust fund set up or not, will also come into play.

Who Exactly is Responsible: It can be difficult for the average person to determine who exactly is responsible for exposing victims to asbestos. For example, companies can move, go out of business, hide, suppress relevant information, and change ownerships. In some cases, your former company is responsible, the manufacturer of the asbestos products may be responsible, or supervisors and/or owners may be responsible. In other instances, there may be just one sole responsible entity, yet in a different case, there may be several responsible parties. Remember that part of the law firm’s job is to research, seek out, and determine the entity or responsible parties that are liable for your exposure to asbestos.

What Are Law Firm Fees?
Law firms may have different fees as well as different payment options. However, an experienced and caring law firm understands that victims of asbestos-related diseases more than likely have enough financial burden in dealing with their illness, and are unable to afford up-front fees for legal representation. As a result, many firms work on what’s known as a contingency fee basis, meaning that they only get paid when you get paid.

If the law firm doesn’t win your case, they don’t receive compensation either in most instances. The good news, however, is that a firm has to be confident enough in your case to take it on, meaning there is a good chance that if your case is picked up, it will be successful.

Law firm fees are percentages taken out of your total settlement or verdict amount, and again, the percentage amount will vary depending upon the firm. Make sure you understand how the fees and percentages work with the firm beforehand so that there will be no confusion later on.

If a law firm doesn’t provide a contingency fee basis, there is a good chance that they don’t have the financial resources to successfully prove your case. Keep in mind that you’ll want a firm that has the financial capability to take on your case on a contingency fee basis.

Attorneys without the resources to handle your case usually can’t provide you with the best representation. An ideal rule of thumb is to ask up-front about how the fees work so that there are no surprises later on. Attorneys with your best interest in mind will have no problems answering any questions you have regarding fees and prices.

Frequently Asked Questions
Do I have to go to court?

This is one of the most commonly asked questions, which is understandable, as most people who are dealing with an asbestos-related illness generally do not want to spend time in a court room. Generally, you will not have to go to court. Most mesothelioma lawsuits are taken care of via settlements.

In some instances, however, if the defense doesn’t agree on a settlement or if you don’t agree on a settlement, you may have to go to trial, which requires going to court. An experienced law firm will help you through every step of the way, and if you are too ill to attend, arrangements can be made to record your testimony beforehand.

What if I don’t know which company exposed me to asbestos?

As previously mentioned, part of an asbestos law firm’s job is to uncover the parties responsible for your asbestos exposure. The culpable parties are typically manufacturers who supplied asbestos to job sites, which can range from one company to many.

I have workers’ compensation benefits. Can a law firm still help me even if I have other compensation benefits?

Other compensation benefits, such as workers’ compensation or VA benefits, doesn’t disqualify you from seeking compensation from the companies who exposed you to asbestos. An asbestos law firm can help you file a lawsuit against the responsible parties.

Additional Tips to Remember
When searching for a law firm, you shouldn’t narrow your search down to your local community only. There’s a chance that your case may be filed out of state.
An experienced mesothelioma lawyer should have no problems flying to your city to meet with you, given that they are out of state.
Although the law firm should be able to give you an average figure that you may receive, giving an exact amount is impossible. Any firm that guarantees you an exact amount should be considered untrustworthy.
A mesothelioma should be able to handle not only mesothelioma cases for survivors, but wrongful death cases involving asbestos exposure.

Filing a Mesothelioma Lawsuit
To start the process of seeking compensation for a mesothelioma client, ELSM begins with a brief introductory meeting. During this meeting, an attorney from ELSM will outline the various steps of the legal process; address any questions or concerns you may have related to the legal process; and discuss the ways in which a mesothelioma client has been exposed to asbestos.

Learn About Your Legal Rights
After this introductory meeting, ELSM will work on your behalf to collect all diagnosing medical reports from the medical facilities where you were treated. Before a mesothelioma lawsuit is filed, ELSM performs a thorough work history investigation of the diagnosed party. ELSM will collect work history records, including, union records, military service records, and other documents to substantiate employment history. In addition to interviewing the mesothelioma client, ELSM will also identify any potential family members, co-workers, and other product identification witnesses who can assist in providing details about the work history and potential asbestos exposure in the case.

After we have completed a thorough product identification and work history investigation, our next step is to identify potential recoveries through asbestos trusts. A number of companies have admitted past asbestos liability and have set up asbestos trusts to compensate mesothelioma clients who present qualifying claims. ELSM is familiar with these asbestos trusts and their requirements for successful claims submission. For the most part, compensation through these trusts happens relatively quickly assuming your particular case meets each trust’s exposure criteria.

$32 Billion Available in Asbestos Trusts for Mesothelioma Victims

To help cover medical costs and provide financial security.

After your case has been evaluated for recovery through the asbestos trusts, ELSM then begins investigation of your case against viable companies who have yet to fully admit their asbestos liability. After an investigation period of about 30 to 60 days, ELSM will determine the proper venue to file the legal action. Venue selection is extremely important and is determined based on a number of factors including: a thorough understanding of scheduling, process time-frame, settlement history, and local laws. ELSM can file a lawsuit in any forum where a mesothelioma client has resided, worked, or served in the military. ELSM can also file your lawsuit in “open forum” states that are agreeable to allowing non-resident / non-exposure claimants to file.

As soon as the proper forum is determined, ELSM will file a formal Complaint on behalf of the mesothelioma client. The Complaint will typically assert various legal causes of action against the asbestos companies likely responsible for causing or contributing to a mesothelioma client’s diagnosis. The number of asbestos companies or defendants named in the Complaint will vary based on the specific type and amount of exposure a mesothelioma client may have had during his/her lifetime.

After filing the Complaint, the Discovery phase commences and usually lasts 3 to 4 months. Discovery allows ELSM to present information to the Defendant asbestos companies which document where, when, and how the mesothelioma client was exposed to particular asbestos products. ELSM can present this information via written documents (interrogatories) and/or oral testimony (deposition) to the Defendant asbestos companies. The Defendant asbestos companies will also be entitled to present information and/or documentation to your attorney during this period. ELSM will also file appropriate motions in Court during the Discovery phase on the mesothelioma client's behalf. Additionally, ELSM will likely try to reach some financial settlement(s) during the Discovery phase.

Most mesothelioma lawsuits will not end up going to trial, but rather will resolve in settlements well in advance of the trial date. Throughout the entire process, ELSM will discuss the strengths and weaknesses of seeking trial resolution vs. settlement with the mesothelioma client. ELSM values continued client input and respects the client’s right to decide what may be in his/her best legal interests. Should a matter proceed to trial with your approval, ELSM is experienced, qualified, and prepared to do so.

Joe Lahav, Lawyer and on-site legal advisor
“You should think about choosing a mesothelioma attorney the same way you would choose a mesothelioma doctor. You wouldn’t go to a podiatrist if you needed treatment for mesothelioma in your lungs. Likewise, you shouldn’t just assume any attorney is capable of handling a mesothelioma claim.”

— Joe Lahav
Lawyer and on-site legal advisor

Bankrupt asbestos companies have set aside billions to compensate people diagnosed with asbestos-related diseases. Asbestos trust fund claims are filed out of court and can get those injured by negligent companies the compensation they deserve — often quicker than a traditional lawsuit.

Military veterans exposed to asbestos during service can file a disability claim with the U.S. Department of Veterans Affairs (VA). A qualified mesothelioma attorney can help veterans navigate the complicated VA claims process as well as legal routes.
